This Refund and Cancellation Policy describes Our policies and procedures regarding cancellations, changes, refunds and related matters for trips, journeys, experiences and other travel services offered by VYOMA. Interpretation and Definitions

Interpretation

The words whose initial letters are capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of this Refund and Cancellation Policy:

  • Company (referred to as either “the Company”, “We”, “Us” or “Our”) refers to VYOMA.

  • Website refers to VYOMA, accessible from https://vyomaexperiences.com/.

  • Trip means any travel journey, experience, itinerary, package or departure offered by VYOMA.

  • Booking means a confirmed reservation made by You for a Trip or Service offered by Us.

  • Booking Amount means any amount paid by You towards confirming or securing a Booking.

  • Customer (referred to as either “You” or “Your”) means the individual making or holding a Booking with Us.

  • Service Provider means any third-party supplier involved in providing services connected with a Trip, including hotels, airlines, transportation providers, tour operators, activity providers, guides, venues or other travel partners.

  • Cancellation means Your request to cancel a confirmed Booking or Trip participation.

  • Refund means an amount returned to You following an eligible cancellation or other circumstance in accordance with this Policy.

Booking and Payment

A Booking is considered confirmed only after We have received the required payment and issued confirmation of the Booking.

The payment amount, payment schedule, balance payment due date and applicable cancellation terms may vary depending on the Trip, departure date, availability and the services included in Your Booking.

The applicable Booking terms communicated to You at the time of reservation or confirmation shall form part of Your Booking and should be read together with this Refund and Cancellation Policy.

You are responsible for ensuring that all information provided during the Booking process is accurate and complete.

Cancellation by You

You may request cancellation of Your Booking by contacting Us through the contact details provided on Our Website.

Cancellation requests should be submitted in writing. The effective date of cancellation will generally be the date on which We receive Your written cancellation request.

Refund eligibility will depend on:

  • the Trip and departure date;

  • the date on which the cancellation request is received;

  • the amount already paid;

  • commitments and payments made by Us to Service Providers;

  • whether the relevant travel services are refundable or non-refundable; and

  • any specific cancellation terms communicated to You at the time of Booking.

Because Our Trips may involve advance reservations and arrangements with third-party Service Providers, certain amounts may become non-refundable once committed or paid.

Non-Refundable Costs

Certain components of a Trip may be non-refundable due to the policies of airlines, hotels, transportation providers, activity providers, venues, travel partners or other Service Providers.

Where such costs have already been incurred or committed and cannot be recovered by Us, We may deduct those amounts from any refund otherwise payable to You.

Any applicable cancellation charges or non-refundable amounts will be communicated to You where reasonably possible.

Refund Eligibility

Where a cancellation is eligible for a refund, We will determine the refundable amount after taking into account the applicable Booking terms, cancellation conditions and any non-refundable costs incurred in connection with Your Trip.

If no refund is due under the applicable cancellation terms, no refund will be issued.

Refunds will generally be made to the original payment method used for the Booking unless otherwise agreed by Us or required by applicable law.

Processing of Refunds

Once a refund has been approved, We will initiate the refund within a reasonable period.

The time required for the refunded amount to appear in Your bank account, card account or payment account may vary depending on the payment provider, bank or financial institution involved.

We are not responsible for delays caused by banks, payment gateways or other third-party payment providers after the refund has been initiated by Us.

Cancellation or Changes by VYOMA

We reserve the right to modify, reschedule or cancel a Trip where reasonably necessary due to operational requirements, availability, safety concerns, circumstances beyond Our reasonable control, or other factors affecting the planned Trip.

If We cancel a Trip before departure, We will communicate the available options to affected Customers.

Depending on the circumstances, available options may include:

  • transferring the Booking to an alternative departure;

  • receiving a credit towards another Trip; or

  • receiving a refund of eligible amounts paid to Us.

The specific remedy available may depend on the circumstances of the cancellation and the amounts that We are able to recover from relevant Service Providers.

Where a Service Provider cancels or materially changes a service included in a Trip, We will make reasonable efforts to arrange an appropriate alternative where possible.

Changes to a Booking

Requests to change a confirmed Booking, including changes to dates, departure, services or other arrangements, are subject to availability and may result in additional charges.

Any additional costs imposed by airlines, hotels, transportation providers or other Service Providers may be payable by You.

A requested change may also be treated as a cancellation and new Booking where the original arrangements cannot be amended.

Force Majeure

We shall not be liable for cancellation, interruption, delay or changes to a Trip resulting from circumstances beyond Our reasonable control.

Such circumstances may include, but are not limited to:

  • natural disasters;

  • severe weather conditions;

  • epidemics or pandemics;

  • war, terrorism or civil unrest;

  • government restrictions or orders;

  • border closures;

  • strikes or industrial action;

  • transportation disruptions;

  • changes in immigration or travel requirements;

  • acts of God; or

  • other circumstances that could not reasonably have been prevented or anticipated.

Where such circumstances affect a Trip, We will make reasonable efforts to communicate with You and explore available alternatives.

Refunds in such circumstances will depend on amounts recoverable from Service Providers and the specific terms applicable to Your Booking.

Travel Insurance

We strongly recommend that Customers obtain suitable travel insurance covering cancellation, interruption, medical emergencies, baggage loss, delays and other risks associated with travel.

Travel insurance is the Customer’s responsibility unless specifically stated otherwise in the Booking.

VYOMA shall not be responsible for losses that are reasonably recoverable through the Customer’s travel insurance policy.

No-Show

If You fail to arrive for a Trip or do not use a service included in Your Booking without providing the required cancellation notice, the Booking may be treated as a no-show.

No refund will generally be available for unused services resulting from a no-show, subject to any rights You may have under applicable law or the specific terms of Your Booking.

Unused Services

No refund will generally be provided for services, accommodation, transportation, activities or other components of a Trip that You voluntarily choose not to use after the Trip has commenced.

This includes, but is not limited to, late arrival, early departure, missed activities or voluntarily leaving a Trip before its scheduled completion.

Special Circumstances

If You are unable to travel due to illness, personal circumstances, visa issues, flight disruptions or other reasons, You should contact Us as soon as possible.

We will review the circumstances and applicable Booking terms and, where possible, assist You with available alternatives.

Any refund or credit in such circumstances remains subject to the cancellation terms applicable to Your Booking and the policies of relevant Service Providers.

Refund Disputes

If You believe that a refund has not been processed correctly, You should contact Us with Your Booking details and relevant supporting information.

We will review the matter and respond within a reasonable period.

Nothing in this Policy is intended to exclude or limit any rights that You may have under applicable law.

Amendments to This Policy

We may update this Refund and Cancellation Policy from time to time.

Any changes will be posted on this page together with an updated “Last updated” date.

You are advised to review this Policy periodically for any changes.

Changes to this Policy will become effective when they are posted on this page, unless otherwise required by applicable law.
